A Tentative Discussion on the Improvement of Procedures for Changing and Adding Enforcement Parties

In civil litigation, the enforcement procedure is an important link to ensure judicial justice. However, for many reasons, the parties involved in the enforcement may change, which directly affects the progress of the enforcement procedure. This article first points out that the current “Amendment and Addition Regulations” have problems such as insufficient supply of procedural norms, unclear review subjects, undefined application time, and incomplete relief channels. By comparing the enforcement document systems of Germany, Japan and the relevant systems in Taiwan region, this paper puts forward improvement suggestions such as expanding the applicable scenarios, clarifying the procedure initiation methods, improving the review procedures and strengthening the protection of procedural rights and interests, with the aim of constructing a more scientific, reasonable and efficient procedure for the change and addition of enforcement parties.
