Problems of public control over the realization of property rights of territorial communities

The purpose of this article is to identify the specific features of public oversight in the implementation of the property rights of territorial communities. It has been established that public oversight represents a complex societal construct whose mission is to create the prerequisites for the continuous improvement of the activities of accountable entities through the identification and analysis of errors in their conduct and the development of means to eliminate them. Such oversight acquires particular significance in the context of exercising the property rights of territorial communities, which constitute the fundamental material and financial foundation of local self-government in Ukraine, ensuring the community’s ability to meet a wide range of needs and support sustainable development. It is determined that in the context of the functioning of small settlements, where the leadership of the territorial community is often connected to the majority of residents of a particular village or township through familial or other close ties (such as attending the same school or working at the same enterprise), the effectiveness of public oversight may be diminished. This creates conditions for abuse in the management of communal property. The article emphasizes that in order to enhance public oversight of the property rights of territorial communities, it is necessary to improve the informatization and transparency of communal property management. This will enable community residents to have free access to relevant information. It is concluded that the development of a system of public oversight in territorial communities that aligns with the stated goals should be based on state support for the development of three fundamental conditions: increasing residents’ informational awareness about communal property assets, their market value, and the actual cost of rent or sale in case of alienation; raising the legal culture of territorial community residents, including their active engagement in legal education initiatives and acquiring skills for organizing public hearings when addressing matters of local importance; promoting greater social responsibility among community members for the state of development of systems for social, medical, and logistical support of community life, fostering conditions for free competition among business entities, and advancing the educational environment, among other areas.
