CONTRADIÇÕES ENTRE A CONVENÇÃO SOBRE DIVERSIDADE BIOLÓGICA, ACORDO E ADPIC: UM CONFLITO ENTRE SOBERANIA E DIREITOS DE PROPRIEDADE INTELECTUAL
This article analyzes the contradictions between the Convention on Biological Diversity (CBD) and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), highlighting the conflicts between their approaches to protecting biodiversity and sharing the benefits of genetic resources. The research emphasizes how biopiracy, a practice that involves the misappropriation of genetic resources and traditional knowledge, affects the sovereignty of countries and generates environmental and ethical crises. The study reveals that while the CBD seeks to guarantee access and fair sharing of benefits derived from genetic resources, TRIPS, with its emphasis on patent protection, contributes to the strengthening of practices that favor corporate interests to the detriment of the needs of developing countries. The analysis concludes that the lack of effective regulations on biopiracy and the discrepancies between these international treaties result in serious challenges for the protection of natural resources and the promotion of socio-environmental justice.
