Prospects for Legal Regulation of Social Relations in Healthcare in the Conditions of Artificial Intelligence Application

Introduction: the article discusses current trends and risks associated with the use of artificial intelligence in healthcare. Medicine is one of the main areas of application of many modern technologies. However, the utilization of some technological innovations is insufficiently regulated by law or not regulated at all, which results in organizational difficulties and causes distrust among a large number of patients. Purpose: to review the main technologies based on artificial intelligence used in healthcare, to analyze the international and domestic legislative framework regulating this field, to identify the most dangerous obvious and non-obvious risks of using such technologies in modern medicine, to evaluate the risks and propose possible ways to overcome them. Methods: the study employed general scientific methods, including description, observation, analogy, comparison, induction and deduction, analysis and synthesis, as well as special scientific methods such as comparative-legal and formal-legal ones. Results: the paper presents the mechanisms for improving the quality of medical care that take into account the risks of the application of artificial intelligence; the study shows that the development of genetic technologies threatens the constitutional right to health protection, the right to protection of personal data, the right to protection of genetic information, the right to work, the principles of non-discrimination, social equality. Currently, the collection, storage, analysis, and use of genetic information by private companies should be restricted by law. Conclusions: it is necessary to improve domestic legislation regulating the rights of individuals and citizens to control the use of their genetic information, to regulate the procedure for training doctors and other specialists providing medical care through the use of technologies based on artificial intelligence, to create new state systems for assessing the quality of medical activities. The widespread introduction of artificial intelligence into all social processes is one of the main trends of our time; therefore, large-scale reforms of law, healthcare, education, and scientific activities seem inevitable.
