Research on the Public Disclosure of Administrative Penalty Decisions
The newly revised Article 48 of the Administrative Penalty Law of the People’s Republic of China in 2021 sets “having a certain social impact” as the public standard for penalty decisions, but this concept is vague and lacks detailed provisions, leading to problems such as inconsistent recognition standards and different disclosures for the same case in practice, and may infringe on the privacy rights of the parties involved. Therefore, it is necessary to first clarify the specific connotation of “having a certain social impact”, establish a scientific method for public judgment, and regulate the form and content of disclosure accordingly, while protecting the public’s right to know and protecting individual rights and interests, and promoting the effective implementation of this provision.
