PELINDUNGAN HUKUM BAGI PASANGAN DALAM PERKAWINAN TIDAK TERCATAT (SIRI) TERKAIT KEPEMILIKAN HARTA BENDA: STUDI KOMPARATIF DENGAN PERKAWINAN TERCATAT

This study aims to examine the form of legal protection of property ownership for couples in unregistered marriages (siri), as well as to make a comparison with the legal system that applies to officially registered marriages in the state. The problem raised stems from the number of couples who undergo marriage without official registration, which has an impact on the uncertainty of the legal status of property, especially in the event of divorce or division of inheritance. This status uncertainty often causes harm to one of the parties, especially women, due to the absence of formal binding legal force. Existing legal provisions have not explicitly regulated the protection of property ownership in siri marriages, so in practice, such protection is highly dependent on the interpretation of law enforcement officials or casuistic court decisions. This poses a risk of injustice, especially when there is no written evidence of the contribution or origin of property. This research uses a normative-empirical approach, which combines the study of written legal norms such as Law Number 1 of 1974 concerning Marriage, the Civil Code (KUHPerdata), and Islamic law with empirical data obtained through interviews and observations of legal practices in the community. The data obtained is then analyzed using data reduction, data presentation and verification (conclusion drawing) techniques in order to obtain an in-depth understanding of the gap between legal norms and practices in the field. The results of the study show that marriage registration is important for legal protection of joint property. Marriage confirmation and the principle of obligation are alternatives for couples in unregistered marriages. This research is expected to contribute to the development of a legal protection system that is more fair, adaptive, and in favor of both parties in the context of property ownership, especially for couples in unregistered marriages.
