Perlindungan Merek Dagang Di Cianjur: Studi Kasus Penindakan Pidana Terhadap Produk Palsu Dan Bajakan

Trademark protection in Cianjur Regency has become an important issue along with the increasing circulation of counterfeit and pirated products that are detrimental to legitimate brand owners, consumers, and the business climate in general. This study examines the law enforcement mechanism for trademark violations based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications, as well as a case study of the Cianjur District Court decision Number 143/Pid.Sus/2025/PN Cjr. The results of the study show that the law enforcement process begins with a complaint, followed by an investigation, search, and examination of evidence, but still faces challenges in the form of low public legal awareness and the complexity of the counterfeit product distribution network. Trademark violations have an impact on economic losses and the reputation of brand owners, reduce consumer trust, and create unhealthy competition in the market. Brand protection efforts in Cianjur need to be strengthened through education, ease of trademark registration for MSMEs, and collaboration between the government, law enforcement officers, and the community in order to create a healthy and competitive business climate.
