The Problem of Criminalization of Aiding Behavior in Cyber Crime

网络信息技术的快速发展，极大地便利了人们的生活，也在很大程度上扩展了犯罪的形态：网络空间不仅被用作犯罪活动的载体，同时也成为实施犯罪行为的重要工具，并构成了犯罪活动发生的环境。到底应该如何应对网络犯罪成为犯罪控制与社会治理中的核心议题。网络犯罪中涉及的协助行为，指的是在该领域内具体实施帮助行为的具体表现形式，其危害性和独立性日益凸显，给刑事归责带来了诸多挑战，如何规制网络犯罪帮助行为已经引起了社会各界的广泛关注。帮助行为正犯化是近几年来刑法学界关注度比较高的一个热门课题，本文通过对网络犯罪帮助行为正犯化现状和争议焦点问题的分析，分别从立法和司法等方面提出建议，以期改善我国的网络服务法律环境，维护网络空间的健康有序发展，构建一个晴朗公正的数字生态。The rapid development of information network technology has greatly facilitated people’s lives while also significantly expanding the forms of criminal activities: information networks have become targets, tools, and spaces for crime. How to effectively combat cybercrime has thus become a core issue in crime control and social governance. Cybercrime aiding behavior, as a specific manifestation of aiding behavior in the field of cybercrime, has seen its harmfulness and independence become increasingly prominent, posing numerous challenges to criminal liability attribution. The regulation of cybercrime aiding behavior has therefore attracted widespread attention from all sectors of society. The criminalization of aiding behavior has been a highly debated topic in criminal law academia in recent years. This paper analyzes the current state and key contentious issues regarding the criminalization of cybercrime aiding behavior and proposes recommendations from legislative and judicial perspectives. The aim is to improve China’s legal framework for network services, ensure the secure and stable development of cyberspace, and foster a clean and upright online environment.
