Legal Protection of Patients’ Medical and Health Information in the Metaverse Healthcare
The metaverse healthcare presents vast potential, yet it still faces significant legal deficiencies. As metaverse healthcare gradually emerges, investigating how to better protect patients’ medical and health information rights is of practical importance. This paper begins by examining metaverse healthcare and patients’ medical health information, analyzing the nature of such information and the existing legal protection mechanisms. It identifies three major shortcomings in the current legal framework and proposes targeted improvements: The introduction of a no-fault liability system with a reference to product liability, the refinement of harm determination standards, and the enforcement of informed consent regulations. These suggestions aim to address the challenges that existing laws encounter in dealing with metaverse healthcare, thereby ensuring the protection of patients’ medical and health information rights.
