Pomen tranzicijske pravičnosti za spoštovanje človekovega dostojanstva v povojnih razmerah
The article examines the significance of transitional justice and national reconciliation in stabilizing democracy in post-authoritarian and post-conflict societies, with a particular emphasis on the crucial role of realizing human dignity. It argues that stabilizing democracy necessitates a responsible engagement with the past, especially through the recognition and redress of abuses perpetrated by non-democratic regimes. Transitional justice is identified as a pivotal mechanism that not only facilitates legal accountability but also aids in the repair and restoration of the social fabric, thereby enhancing the realized dignity of individuals, particularly victims. The authors note that the effectiveness of transitional justice is frequently constrained by ideological polarization, elite dominance, and the politicization of the process, which can impede the attainment of genuine national reconciliation and stable democracy.
