REFLECTIONS ON FREEDOM OF EXPRESSION IN THE LIGHT OF THE PROTESTS AGAINST ISRAEL: A COMPARATIVE ANALYSIS OF THE AMERICAN AND FRENCH LEGAL EXPERIENCES

The echo of the Israeli-Palestinian conflict has reached the attention and sensitivity of students from all over the world, causing student demonstrations inside the university that have caused the occupation of university spaces and the boycott of some academic activities. In particular, these effects have been very visible in the United States, while in France the government has managed to avoid the consequences of these demonstrations. In both cases, there was a police intervention to restore the correct administration of academic activities. During demonstrations, students have called for freedom of expression, accusing national governments of preventing the exercise of this right. By this contrast of positions, the following contribution intends to examine how freedom of expression is regulated in the two countries and what are the limits that it encounters when exercised within school/university environments. In particular, the intention is to propose a focus on the balance between the freedom of expression of students and their right to have academic services provided and those of a national system to see maintained respect for public order that we can define special because it is recognized and protected in particular within cultural places such as schools or universities.
