The comparative analysis demonstrates that countless energy disputes are highly heterogeneous, as they are extremely diverse and governed by numerous statutory instruments. This places considerable responsibility on commercial courts to correctly apply them in examining and resolving such disputes. In light of the existence and requirements of adversarial procedures in modern commercial court proceedings, there is a need to more effectively use the institution of proving for establishing the truth as a way of achieving the goals of commercial court proceedings and successfully examining and resolving energy disputes, ensuring the protection of the rights and legitimate interests of parties to legal relations in the fuel and energy sector
