Research on the Security Assurance Obligations of E-Commerce Platforms

At present, we are in an era of rapid development of the online economy. E-commerce platforms have gradually replaced physical stores and have become one of the main places for citizens’ daily consumption. Currently, the legal norms in China have set security guarantee obligations for the operators of e-commerce platforms. From the perspectives of risk control theory and compensation principle, institutional evolution, and consumer rights protection, the establishment of this obligation has its legitimacy. However, in the current legal system, there are still many deficiencies in the usage norms of the security guarantee obligations of e-commerce platform operators. In this regard, the interpretation of the security guarantee obligations of e-commerce platform operators should be reconstructed from the perspective of consumer rights protection based on the provisions of Article 38, Paragraph 2 of the “E-commerce Law”.
