A LEI Nº 636, DE 13 DE NOVEMBRO DE 1953, E O PATRIMÔNIO DA POVOAÇÃO DE BOCAINA NO MUNICÍPIO DE BARRA DO BUGRES (MT): MEMÓRIA, RESISTÊNCIA E OMISSÕES NO PROCESSO DE REGULARIZAÇÃO FUNDIÁRIA

This article is based on an investigation into Law No. 636 of November 13, 1953, which was supposed to guarantee land rights for traditional families in the Bocaina region of Mato Grosso. Despite the legal provision for 5,000 hectares, 1,500 for the village and the remainder for small farmers, the law never materialized. What we see in practice is a history marked by omission, land grabbing, and land-grabbing violence. The community, now recognized as quilombola, continues to fight for its title even after decades of institutional neglect. The research draws on documentary sources, historical records, interviews, and previous studies, seeking to understand how a law can exist for over 70 years without being enforced—and what this reveals about the relationship between the State, memory, and territory. Bocaina’s trajectory, marked by resistance, oblivion, and reclaiming, reveals how legal recognition alone is insufficient to guarantee land justice.
