Konsensualizm procesowy w sprawach przestępstw przeciwko wolności seksualnej a ochrona godności pokrzywdzonego
The obligation to respect the dignity of the victim taking into account his/her legally protected interests (art. 2 Polish Code of Criminal Procedure) is a procedural emanation of the constitutional obligation of to respect the dignity of every human being. The purpose of the article was to verify the scope of protection of victims and respect for their dignity in the application of conviction without trial, conviction without evidence and mediation in cases of sexual offenses and its compliance with European guidelines. The considerations were supplemented by an analysis of empirical studies on the frequency of application of procedural consensualism in cases of sexual crimes and the role of the victim’s objection to their application – using the crime of rape as an example.
