The Confidence Vote Mechanism in the Federal Republic of Germany: a Tool of Stabilization or Political Manipulation?

A vote of confidence is one of the key systemic instruments in the chancellor’s system of government, serving a stabilizing function and enabling the dissolution of the Bundestag and the calling of early elections. In German political practice, it has been used repeatedly both to strengthen the government and as part of the chancellors’ strategic calculations. This article examines the constitutional basis for using a vote of confidence as a mechanism leading to early elections. The key question is: does such a measure fall within the bounds of a permissible interpretation of Art. 68 of the Basic Law? How does it affect the stability of the system of government? Theoretical considerations will be set in the context of the Federal Constitutional Court’s case law and political practice, analyzing cases of deliberate defeat of votes of confidence and the boundaries between the constitutional use of this institution and its political abuse. 68 Ustawy Zasadniczej? Jak wpływa na stabilność systemu rządów? Abstract

Rozważania teoretyczne zostaną osadzone w kontekście orzecznictwa Federalnego Sądu Konstytucyjnego i praktyki politycznej, analizując przypadki celowego przegrywania głosowania nad wotum zaufania oraz granice między zgodnym z konstytucją stosowaniem tej instytucji a jej politycznym nadużyciem.
