Glosa do wyroku Naczelnego Sądu Administracyjnego z 18 maja 2020 r., sygn. akt I OSK 4150/18
Commentary on the Judgment of the Supreme Administrative Court of 18 May 2020, file ref. no. I OSK 4150/18 The primary purpose of the study is to assess the validity of the Supreme Administrative Court’s position with regard to the manner of qualifying the content of an anonymous report as information that does not constitute public information within the meaning of Article 1 (1) of the Law on Access to Public Information. The author emphasizes the legitimacy of the Supreme Administrative Court’s ruling but raises some contentious and questionable issues. In addition, the author attempts to determine whether the position of the Supreme Administrative Court expressed with regard to the specifics of anti-bullying proceedings can be identically applied to the manner of qualifying the content of anonymous reports within the meaning of the provisions of the Law on the Protection of Whistleblowers. 1 ust. 1 ustawy o dostępie do informacji publicznej.
