O konwencjonalizującym charakterze wniosku KRS w kontekście prezydenckiej kompetencji powoływania sędziów

On the Conventionalizing Nature of the Proposal of the National Council of the Judiciary in the Context of the Presidential Competence to Appoint Judges The theoretical-legal concept of conventional acts has been present in Polish legal discourse for almost 50 years. Recognizing its importance for the logical explanation of legal problems, this work attempts to explain from this perspective the nature of the National Council of the Judiciary proposal as an element co-shaping the presidential competence norm concerning the appointment of judges. Beginning with considerations of the assumptions of the concept of conventional acts, the author outlines arguments in favor of assigning the nature of the proposal of the National Council of the Judiciary as a rule conventionalizing the appointment of a judge. The entirety of the considerations leads him to the conclusion that it is necessary to reject – sometimes promoted e.g. in the presidential application to Constitutional Court in case I Kpt 1/23 – the thesis about the nature of the presidential act of appointing a judge as “curing” all irregularities. Abstract

Ogół prowadzonych rozważań prowadzi go zaś do wniosku o konieczności odrzucenia – promowanej m.in. w prezydenckim wniosku o rozstrzygnięcie sporu kompetencyjnego zarejestrowanym pod sygn. I Kpt 1/23 – tezy o „uzdrawiającym” wszelkie uchybienia charakterze prezydenckiego aktu powołania na urząd sędziego.
