Legal regime of spontaneous gatherings in the Republic of Serbia
Spontaneous mass gatherings are public gatherings characterized by an unorganized manner (without an organizer of mass gatherings), and as such they represent an immediate reaction to an event/mass gathering for the purpose of expressing public opinions and attitudes. The urgent need for their existence and lack of organizational elements differentiates such mass gatherings from other types of public mass gatherings. In terms of legality, such gatherings are not subject to procedural limitations with respect to time when they should take place. They enjoy legal protection as long as they are characterized by either peaceful assembly. Public gatherings are broken up if there are legally justified reasons for their dispersion. The legal regime in the Republic of Serbia with regards to spontaneous mass gatherings is governed by law and as such it implies the existence of an urgent need for their organization and absence of an organizer of mass gatherings, as well as the obligation to report thereof to a competent authority and state the time of its organization. Such mass gatherings enjoy legal protection as long as they are of a peaceful character or until some legally justified reasons require their dispersion.
