Abstract

One of the characteristics of the right to construction as a long-term real right is its stability. The fact that the legislator includes the right to construction among the limited real rights implies not only the recognition of this right and the provision of guarantees for its implementation by the state and other persons but also the effective and comprehensive protection of this right. The right to construction, bearing at the same time the characteristics inherent in both property and obligation law, is distinguished by its unique methods of protection, to the study of which this article is devoted. In the article, the author addresses the methods of civil legal protection of subjective rights enshrined in the legislation of the Republic of Armenia, in particular, their applicability to the right to construction, based on a comparative legal study, as well as presents the legal experience of foreign countries, identifies their similarities and differences with the legal regulations existing in the legislation of the Republic of Armenia. Based on the legal norms presented in the article, the cited legal positions, and the legal analysis, the author highlights the practical problems arising in legal relations in practice around the legal protection of the right to construction, identifies the nature of these legal relations, and presents her point of view on possible options for their solution, presenting her proposals aimed at improving the legislation of the Republic of Armenia.
