THEORETICAL FOUNDATIONS OF INTERACTION BETWEEN LAW ENFORCEMENT AGENCIES AND OTHER ACTORS IN THE PREVENTION OF OFFENSES IN THE FINANCIAL SECTOR

Rekunenko T. O. Theoretical foundations of interaction between law enforcement agencies and other actors in the prevention of offenses in the financial sectorThe article presents the theoretical and legal foundations of interaction between law enforcement agencies and other entities involved in the prevention of offenses in the financial sector. It defines interaction as a systemic, coordinated, and purposeful activity of various state institutions aimed at detecting, preventing, and minimizing negative financial phenomena and violations. The principles of such cooperation are outlined, including legality, coordination, promptness, institutional accountability, and adherence to competence. The author analyzes the main forms of cooperation between agencies, such as information and analytical exchange, joint inspections and monitoring, coordination meetings, interdepartmental working groups, and the exchange of statistical and risk-oriented data.Special attention is given to organizational interaction during the investigation of complex financial schemes, tax evasion, illegal transfer of funds abroad, and financing of the shadow economy. The article also highlights the broad range of institutions formally authorized to prevent financial offenses in Ukraine, including the State Audit Service, the State Financial Monitoring Service, the State Tax Service, the State Customs Service, the Antimonopoly Committee, the National Bank of Ukraine, the National Securities and Stock Market Commission, and law enforcement agencies (e.g., the National Police, the Bureau of Economic Security). However, it is emphasized that a clear and established mechanism for coordination among these bodies is still lacking. This leads to duplicated powers, insufficient responsiveness, fragmented decisions, and consequently, a decrease in the overall effectiveness of the state's financial prevention policy.Based on the identified shortcomings, the article substantiates the need to develop an integrated approach to interagency cooperation, improve the legal framework, and introduce mechanisms for regularly assessing the effectiveness of such interaction.
