Legal Protection for Victims of Sexual Violence Categorized as Disabled (Case Study of Karawang Task Force on Perpetrators of Sexual Violence Against ODGJ)
Human rights are violated by sexual assault, which has a major effect on victims, particularly those who are vulnerable, including those with mental disorders (ODGJ). Two laws that Safeguard individuals affected by sexual abuse in Indonesia include Law No. 8 of 2016 covering matters of disability inclusion and Law No. 12 of 2022 on Sexual Assault Crimes.. However, in practice, ODGJ victims still face numerous obstacles in obtaining justice, such as social stigma, lack of understanding among law enforcement officials, and weak protection and recovery mechanisms. Through a case study of a rape that took place in Karawang, This studi purpose to examine how legal protections are used for ODGJ victims of sexual assault. According to the study's findings, the judicial system's lack of an inclusive approach means that ODGJ victims continue to lack proper legal protection. As a result, policy changes that are better suited to victims' unique requirements are needed. Furthermore, Protecting the rights of ODGJ victims who have been sexually assaulted requires strengthening law enforcement capabilities and inter-institutional coordination in addition to offering thorough rehabilitation programs
