A JUSTIÇA SOB VIGILÂNCIA ALGORÍTMICA: A INTELIGÊNCIA ARTIFICIAL COMO FATOR DE INCLUSÃO OU EXCLUSÃO NO ACESSO À JUSTIÇA

This paper proposes a legal analysis of the use of artificial intelligence (AI) in the Brazilian legal system. Initially, it explores the benefits that this technology offers, especially with regard to procedural speed, improved jurisdictional provision, and democratization of access to justice. It then critically examines the risks associated with the abusive use of AI, including algorithmic biases, privacy violations, and the lack of civil liability. The study also considers the national and international legislative scenario, as well as the bills currently being processed in the National Congress, discussing their merits and shortcomings. Finally, it proposes legal guidelines for the construction of a solid, democratic, and technically adequate regulatory framework that promotes innovation without compromising fundamental rights.
