E-Commerce Platform Liability and Consumer Protection from the Perspective of the “E-Commerce Law”
This paper takes the implementation of the “E-commerce Law of the People’s Republic of China” as the research background and systematically analyzes its institutional innovations, implementation effects and practical challenges in regulating platform liability and protecting consumers’ rights and interests. Studies show that through institutional designs such as the regulation of the credit evaluation system, the definition of platform liability, and the protection of consumers’ right to know, this law effectively alleviates pain points such as false transactions, bundled sales, and the difficulty in refunding deposits. However, there are still challenges in aspects such as ambiguous standards for responsibility determination, insufficient punishment intensity and regulatory gaps in new business forms. This article suggests further improving the legal governance framework for e-commerce and promoting the high-quality development of the digital economy by measures such as refining the criteria for determining “corresponding responsibilities”, establishing a dynamic fine mechanism, and building a collaborative governance system.
