Legal impact on the risks of rehabilitation of business entities in conditions of full-scale invasion: on the example of the Law of Ukraine no. 3249-ІХ.
This article focuses on the recent armed conflict between Ukraine and Russia, which began with the Russian invasion of Ukraine on February 24, 2022. The conflict is ongoing at the time of writing. Although this conflict is a case of a single event, the scale of the impact considered for this conflict goes beyond Ukraine and Russia, i.e. to the entire world, which makes the conclusions drawn from this study relevant to the international community. This study is also exploratory in nature, the purpose of which is to identify the impact of war on business and society through the prism of the conflict between Ukraine and Russia. The material is analyzed on the fact that war arising from armed conflicts affects business and society in several ways, as well as on the different impacts of war on business and society through the prism of the conflict between Ukraine and Russia in the following areas: 1) the impact of war on society within the aggressor and victim countries; 2) the impact of war on society outside its borders; 3) the impact of war on business within the country; 4) the impact of war on business outside the country. It is proposed to accept the fact that the factors (risks) described above may lead to the opening of a bankruptcy case with the subsequent application of the judicial rehabilitation procedure. It is proven that the regulation introduced in the legal field of Ukraine from February 24, 2025 helps to protect debtors whose assets are located in Ukraine, which allows businesses to maintain stability in such conditions.
