Certain issues of organizing part-time work during martial law

The article analyzes the essence of the organization of labor relations on the terms of part-time work. Attention is drawn to the fact that it is an additional guarantee of the realization by a person of his right to work. Since the full-scale invasion of the Russian state, part-time work has become particularly widespread, as it allows not only to ensure the further development of many industries, but also to receive additional earnings for employees and to implement labor functions that correspond to their professional skills. The Law of Ukraine «On Prevention of Corruption» establishes restrictions on the part-time work of persons authorized to perform state or local government functions, with the exception of teaching, scientific and creative activities, medical practice, instructor and referee practice in sports, however, under martial law, the above restrictions do not apply to civil servants (except for civil servants of category «A»), local government officials (except for officials whose positions are classified as first - third categories), if such persons are on unpaid leave or in case of downtime. Among the positive aspects of organizing part-time employment relations under martial law, the invalidation of the Resolution of the Cabinet of Ministers of Ukraine dated 03.04.1993 No. 245 “On Part-time Work of Employees of State Enterprises, Institutions and Organizations” and the Order of the Ministry of Labor of Ukraine, the Ministry of Justice of Ukraine, the Ministry of Finance of Ukraine dated June 28, 1993 No. 43 “On Approval of the Regulations on the Conditions of Part-time Work of Employees of State Enterprises, Institutions and Organizations” was highlighted, which made it possible not only to discard the remnants of the Soviet period, but also to organize labor relations in accordance with the pace of development of the modern labor market. Attention is drawn to the peculiarities of organizing part-time work when hiring, organizing a work schedule, providing annual leave, payments in case of temporary incapacity for work, declaring, and suspending an employment contract.
