Тhe midge of privacy and confidentiality: legal between the implementation of transparency at the functioning of the NATIONAL ANTI-CORRUPTION BUREAU OF UKRAINE in the mind of the military i will become.

This scientific article explores the implementation of the principle of transparency in the operations of the National Anti-Corruption Bureau of Ukraine (NABU) during the period of martial law, which imposes extraordinary challenges on public institutions. It investigates the complex interplay between the public's legitimate demand for openness, accountability, and democratic oversight of anti-corruption efforts, and the imperative to safeguard national security interests and the confidentiality of sensitive pre-trial investigations. The article reviews the national legal framework regulating transparency in NABU’s activities, focusing on legislative guarantees of access to information, mechanisms of public accountability, and statutory limitations imposed due to considerations of state security and investigative secrecy. Special attention is paid to the concept and implementation of electronic transparency as a modern tool that can expand access to public information while also serving as a safeguard against corruption risks and institutional opacity. The study analyzes a prominent case involving allegations of procurement abuses within the supply system of the Armed Forces of Ukraine to illustrate real-world challenges in balancing transparency with security, especially during armed conflict. This case sheds light on the reputational and operational risks faced by NABU when navigating this delicate balance. The article proposes practical recommendations, including the development of consistent standards for public communication, adherence to the principle of proportionality between openness and the protection of classified information, and the need to update the regulatory framework in line with wartime realities. The author concludes that transparency within NABU is not only a matter of democratic principle but also a strategic asset in reinforcing public trust, enhancing national resilience, legitimizing anti-corruption efforts, and countering disinformation in the context of ongoing war.
