Value-based and legal foundations of building civil society and the rule of law
The scientific article studies and analyzes the value-legal foundations of the development of civil society and the rule of law in Ukraine. This problem is insufficiently researched. Using general and special methods of scientific knowledge, the authors studied scientific sources and current legislative acts that regulate individual aspects of civil society and the rule of law. It was established that the modern development of civil society in Ukraine is based on a set of values that determine its foundations and guidelines. These values not only determine the direction of society, but also influence the behavior and attitudes of individuals, associations and state bodies. The researchers clarified the meaning and content of the value-legal foundations of the development of civil society and the rule of law. The conclusion is made that values are an integral part of the development of civil society, the foundation on which civil society is built. They determine what principles and ideals are important for citizens and public organizations. They form the ideals on which the activity of citizens, public organizations and other participants in public life is based. The article notes that the values on which the development of civil society and the rule of law in Ukraine should be built are hierarchical, which depends on their significance and impact on socio-political and state processes. The authors conclude that the creation of a strong and stable civil society and the rule of law in Ukraine is possible provided that they are based on an appropriate value-based legal basis. It includes a hierarchy of values that reflect the needs and ideals of modern Ukrainian society, including: national security, justice and responsibility, family, private property, public associations, independent non-state media, local self-government, democracy and human rights, openness and transparency, citizen participation, education, science, culture, equality and mutual assistance, diversity, innovation and development. Such values require proper legal support.
