ЗАКОНОДАВЧА КЛАСИФІКАЦІЯ СОЦІАЛЬНИХ ПОСЛУГ

The article examines certain theoretical, legislative, and law enforcement aspects of the classification of social services under Ukrainian legislation. The normative classification is critically analyzed in terms of its effectiveness and the justification for necessary changes required for practical implementation. The necessity of enshrining fundamental and nationwide social services in the Law of Ukraine «On Social Services» is supported. This will facilitate the clear identification of authorized entities responsible for financing and organizing each group of social services. The article supports the necessity of amending the Budget Code of Ukraine and the Law of Ukraine «On Local Self-Government in Ukraine» given the importance of establishing an effective mechanism for beneficiaries to access relevant social services. The need for classification based on the place of service provision is refuted. Such a characteristic is an integral part of the state standard for each service. It is argued that the distinction between simple and complex social services is justified for structuring the Social Services Classifier in Ukraine. Emergency (crisis) social services are recognized as those that should be enshrined in the fundamental Law of Ukraine, as they involve a specific mechanism for the realization of the right to such services. The functional, target, and substantive criteria for classifying social services are analyzed. Keywords: social protection, legislation, standards, legal mechanism for ensuring recipients’ rights, experience of foreign states.
