Legal aspects of preventing violent crimes in the activities of law enforcement agencies
The scientific article analyzes the complex and socially significant phenomenon of violent crimes committed by law enforcement officers in the course of their duties. It is emphasized that such manifestations not only rudely violate human rights, but also substantially undermine public confidence in public authorities, including police, prosecutors and security services. It is determined that effective counteraction to this form of crime requires a systematic and holistic approach, which involves the improvement of both legal regulation and the functioning of preventive institutional mechanisms. In the study, special attention is paid to international standards, in particular the provisions of the European Convention on Human Rights and the UN Convention against torture. It is noted that these acts establish an absolute prohibition of torture and determine the responsibilities of states to carry out effective control and investigation of such cases. The normative legal basis for counteracting violent crimes in Ukraine is determined: the Constitution, the Criminal Code, the Profile Laws, including the Law on the National Police. The role of institutional guarantees in preventing violence is emphasized. The functionality of such subjects of precautionary activity as the Commissioner of the Verkhovna Rada of Ukraine for Human Rights, the National Preventive Mechanism, the State Bureau of Investigation and the Public Councils at the Ministry of Internal Affairs are analyzed. It is noted that the activities of these institutions not only record the violation, but also acts as an important restraining factor and source of initiatives in reforming the law enforcement system. As a result, it is determined that the further development of state policy in the field of prevention of violent crimes should be guided by strengthening the regulatory framework, improving the efficiency of control institutions and introducing international human rights standards. Specific directions of improvement are proposed: strengthening of guarantees of independent investigation, legislative consolidation of mechanisms of interaction of law enforcement agencies with civil society, expanding the powers of controlling entities, as well as modernization of ethical and educational standards for law enforcement officers.
