Improving the legislation of Ukraine on the issues of conducting inspections of the activities of the bodies of the Ministry of Internal Affairs system
The article analyzes the legislation of Ukraine on the legal regulation of the Ministry of Internal Affairs of Ukraine’s inspections of the activities of the bodies of the Ministry of Internal Affairs, namely, the central executive bodies, whose activities are directed and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Internal Affairs of Ukraine, and their territorial bodies. It has been established that, in accordance with the provisions of the legislation of Ukraine, the powers of the minister in relations with the central executive body, whose activities are directed and coordinated through him, include ensuring the formation of state policy in the relevant field and monitoring its implementation by this body. One of the forms of monitoring the implementation of state policy in the relevant field is conducting inspections of the activities of the specified central executive bodies, as well as the use by these bodies of budget funds, the main administrator of which is the ministry. It is determined that it is the Minister of Internal Affairs of Ukraine who makes decisions on conducting inspections of the activities of the relevant central executive bodies, as a result of which he exercises control over the implementation of state policy by the Administration of the State Border Service of Ukraine, the State Migration Service of Ukraine, the State Emergency Service of Ukraine, and the National Police of Ukraine. In addition to the powers of the Minister of Internal Affairs of Ukraine as the initiator of inspections of the bodies of the Ministry of Internal Affairs, the legislation regulates the legal status of the Internal Audit Department of the Ministry of Internal Affairs, which is subordinate and accountable directly to the Minister and vested with control powers over the specified bodies, in particular over control over their use of budget funds, the main administrator of which is the Ministry of Internal Affairs of Ukraine. It is noted that during inspections by the relevant subjects of the Ministry of Internal Affairs of the activities of the bodies of the Ministry of Internal Affairs, a number of controversial issues arise due to problems of legal regulation, gaps and inconsistency of regulatory legal acts regulating the legal status of the Ministry of Internal Affairs and the specified bodies. In order to improve the current legislation on inspections by the Ministry of Internal Affairs of Ukraine of the activities of the bodies of the Ministry of Internal Affairs, it is proposed to make amendments and additions to the current regulatory legal acts that regulate the legal status of the said bodies and regulate the implementation of control and supervisory procedures.
