Administrative and legal regulation of the activities of juvenile police in Ukraine

The article is devoted to the study of the state of administrative and legal regulation of the activities of the juvenile police in Ukraine. The powers of the authorized units of the National Police for Children are grouped depending on their content as follows: 1) those related to the prevention of offenses by children; 2) those related to the detection of offenses committed by children; 3) those related to the protection of children from offenses. It is noted that the use of such a determining feature as «juvenile» is associated with the specifics of the activities of authorized units of the National Police and the mandatory presence of the subject - a child - in these cases. The basis for determining the administrative and legal regulation of juvenile police in Ukraine is a broad approach that covers all provisions that are mandatory for consideration during the functioning of the system of authorized police units for children. The concept of administrative and legal regulation of juvenile police in Ukraine is proposed to be interpreted as a set of legal norms contained in subordinate regulatory legal acts and determining the legal basis for the activities of authorized units of the National Police for children, their tasks, powers, structure, rights and obligations, and the means used to perform the tasks set. The provisions of individual regulatory legal acts that relate to the functioning of authorized units of the National Police for children and can be an applied reflection of their administrative and legal regulation are analyzed. It is noted that at the administrative-legal level of legal regulation, the term “juvenile prevention” is used, and not the term “units of the National Police authorized for children’s affairs”. That is, the main task of the specified entities is obvious. The expediency of bringing the legislation into line through the adoption of a special law is substantiated, which would determine the main characteristics of the juvenile police, which would subsequently be unambiguously used at the level of administrative-legal regulation.
