IMPACTOS E DESAFIOS DA NOVA LEI DE LICITAÇÕES Nº 14.133/2021

The present work was carried out with the objective of analyzing the new Law nº 13.133 of April e, 2021, better known as the New Law on Bidding and Administrative Contracts, given the difficulties faced by municipalities in its institutionalization. Legislative developments were addressed, as well as their application and procedure. In sequence, the main legislative changes were listed, such as the preference for contracting through digital means, removal of the suspension sanction, possibilities for dispute mode, new judging criteria, altered administrative resources, inclusion of competitive dialogue among the bidding modalities and the removal of invitation and price-taking modalities and, finally, the possibility of the direct contracting. On the one hand, it appears to be unfeasible and exhaustive, marked by a lot of bureaucracy and difficult to access methods, on the other, necessary, since the implementation of a new organizational culture aims to meet the real aspects of the public interest. The work was developed using a literature review based on bibliographical research, through research on websites, doctrines, articles and legislation, analyzing the understanding and consequences on the topic.
