Denmark - The Vegetarian Society and the Danish Climate Movement vs. the Cooperative Danish Crown - Rulings of the Western High Court and the Supreme Court:New trends in climate litigation
The article analyses the court rulings (2024) of the Western High Court and the Supreme Court on the Danish Crown Statements: 'Danish pork is more climate friendly than you think', and 'Climate Controlled Pig' in context of the Marketing Practices Act (MPC). Danish Crown had to acknowledge that 'Climate controlled pig' used as labels on pork packages in super markets was unlwful while the first statement was in accordance with the MPA, the Western High Court taking into account consumer awareness about climate impacts of pork. The Supreme Court rules in line with the plaintiff's (Danish Vegetarian Society, and the Danish Climate Movement), since Danish Crown responded in the affirmative meaning that Danish Crown accepted that adversiting claims were in breach of the MPC, and that the statements were banned for five year. Danish Crown ha only used the statements in an advertising campaign in 2021, and had no intention to conduct further campaigns.
