Problems of the Implementation of the Norms on Judicial Acts in Civil Proceedings: Theoretical and Applied Aspects

The article examines the problems of implementing the rules on judicial acts in civil proceedings. The author has identified the following areas of the problem: theoretical problems of implementing the rules on judicial acts; problems of legal regulation of implementing the rules on judicial acts; problems of law enforcement practice of implementing the rules on judicial acts in civil proceedings. As a theoretical problem of implementing the rules on judicial acts, the legal nature of the order procedure and, as a consequence, the court order are identified and analyzed as an example. The problem of appealing the preventive decisions of the court of first instance separately from the judicial act is studied by the author as a problem of legal regulation of implementing the rules on judicial acts in civil proceedings. As a problem of law enforcement practice of implementing the rules on judicial acts in civil proceedings, the problem of the legality and validity of judicial acts is analyzed.
