Mediation in graduate medical education: two practices compared at the intersection of education and dismissal law The resident in training to become a medical specialist must leave the training programme in case of continuous dysfunctioning after one or more failed remediation trajectories. Decisions on remediation and training termination by the program director must comply to a specific regulation, the General Directive from the Medical Specialties Council (CGS; College Geneeskundige Specialismen) of the Royal Dutch Medical Association (RDMA). This regulation separates approaches to mediation for disputes of residents in training for community-based and hospital-based specialties (settings in and outside the hospital). This study into customs of practice and comparison of regulations and case law regarding education and dismissal law recommends harmonization and optimization of practice, including safeguarding the mediators' independence and reconciling regulations for training settings in and outside the hospitals.
