The deprivation of liberty sentence represents one of the most forceful instruments of the statepower to deal with crime. However, throughout history, this approach has been permeated bycontradictions and inefficiency. The prison crisis, added to the increase in recidivism and crime, reveals that the deprivation of liberty sentence fails to fulfill its fundamental objectives. In thisstudy, the general objective is to critically analyze the effectiveness of the deprivation of libertysentence in its resocializing function. As a methodology, documentary, exploratory andbibliographic research was used. It was concluded that the deprivation of liberty sentence, in itscurrent format, is anachronistic, ineffective and incompatible with the objectives of aDemocratic State of Law.
