Understanding IPR infringement: A qualitative Analysis of Apple Inc. v. Samsung Electronics Co., Ltd. case'

This research paper conducted a qualitative analysis of the legal battle between Apple Inc. and Samsung Electronics Co., Ltd., shedding light on the intricate landscape of intellectual property rights (IPR) infringement within the technology industry. Using the NVIVO software for qualitative analysis, our study dissects the Apple Inc. v. Samsung case beyond the courtroom proceedings, aiming to uncover the nuanced impact on innovation, market competition, and the broader tech ecosystem. The research objectives include the identification and examination of specific IPRs, assessment of legal arguments, and exploration of the implications for the tech industry, by comparing the interviews of the Korean and American attorneys who spoke for Samsung Electronics Co. Ltd and Apple Inc. respectively. By drawing comparisons with other relevant cases, we aim to conclude key lessons and contribute insights to future IPR-related disputes. This study is a comprehensive exploration of the intersection between technology, law, and business strategy, offering valuable perspectives for academia, legal practitioners, and industry stakeholders.
