Intellectual Property Rights as Innovation Assets and Their Role in Business Growth
This paper examines the multifaceted impact of Intellectual Property (IP) rights on society, considering both their benefits and challenges. IPrights, including patents, trademarks, copyrights, trade secrets, and industrial design rights, play a crucial role in fostering innovation, creativity, and economic growth by providing legal protection to creators and inventors. However, they also present challenges such as restricted access to essential medicines, potential monopolistic practices, and overprotection that may hinder further innovation. The paper highlights the need to strike a balance between encouraging innovation and ensuring public access to technology, knowledge, and culture. It discusses various determinants influencing the effectiveness of IP rights, including legal frameworks, economic factors, technological capabilities, cultural factors, political environments, and social considerations. The analysis underscores the importance of ongoing adjustments to IP laws and practices to address evolving societal needs and challenges, advocating for an IP policy framework that serves both the interests of innovators and the public.
