Проблемы построения юридических конструкций специальных составов преступлений

The article considers the criminal law structure as a way of constructing a special corpus delicti. The author highlights the problems that arise as a result of ignoring the requirements of legislative technique, and also suggests a number of rules, compliance with which will exclude errors that entail difficulty in applying criminal law norms. In particular, it is proposed to exclude the association of acts with different levels of public danger in one definition. The author also considers it necessary to design a special composition in the hotel norm, unlike qualified compositions. In addition, the author analyzes the process of transformation of the general corpus delicti into a special one, highlighting the key points of such a transformation.
