Незаконное увольнение в свете новой судебной практики: очевидное и невероятное

This article examines a set of problems associated with recognizing dismissal as illegal. It is determined that dismissal is recognized as such in cases of either the absence of a legal basis or in violation of the established dismissal procedure. Particular attention is paid to the latter case and the establishment of the content of the concept of «dismissal procedure». It is noted that modern judicial practice, including guiding practice, is ambiguous on this matter. It is concluded that a number of the considered provisions of the Labor Code of the Russian Federation in light of the emerging judicial practice require greater legal certainty.
