Perlindungan Hak Cipta Dalam Sengketa Analisis Kasus Sketsa Tugu Selamat Datang Mall Grand Indonesia (Studi Kasus Putusan Mahkamah Agung Nomor 35 Pdt.Sus-Hak Cipta 2020)

This study aims to analyze the protection of Intellectual Property Rights (IPR) in the copyright dispute over the Tugu Selamat Datang sketch involving Grand Indonesia Mall. The background of this research stems from the use of the Tugu Selamat Datang sketch as a commercial logo without permission, which triggered a lawsuit by the heirs against Grand Indonesia. This case serves as a significant example of implementing copyright protection, particularly for artworks with historical and cultural value. With a normative juridical approach, this study evaluates the application of law based on applicable laws and regulations. The results of the analysis show that the court decision requiring PT Grand Indonesia to pay compensation of Rp 1 billion is in accordance with legal principles, although there is still the potential for optimizing sanctions to provide a stronger deterrent effect. This study also emphasizes the importance of declarative principles in protecting works of art since they are realized, as well as the need for legal awareness in the use of copyrighted works for commercial purposes. Effective copyright protection not only provides justice for creators and heirs, but also encourages respect for creativity and cultural contributions.
