The Consumer Protection Act, 2019 : A Shield against False / Misleading Advertisements
Advertisement is not a new phenomenon but it is an age old practice and in the era of globalization, it has become most important part and parcel of commercial marketing strategy. The manufacturers, service providers and advertising agencies use the advertisements to allure consumers towards commercial offerings and enhance utilization of the products. False or misleading advertisements not only affect the consumers’ attitude but also violate their right to be informed. Therefore, the false or misleading advertisements are viewed as a commercial and social evil and in the economic wake, these advertisements cause “market failure”.
