Legal regulation of accessibility and protection of information on the activities of courts and the secrecy of judicial proceedings
Effective legal regulation of the dissemination of information in the activities of judicial authorities, as well as the protection of this information, where the court is one of the key elements of the rule of law, is the most important task of the country's policy. The effectiveness of legal regulation largely affects the actual implementation in life of openness and accessibility of judicial proceedings, as well as the real protection of the confidentiality of information that may concern the personal life of citizens, commercial secrets and state security. Russian legislation enshrines the constitutional guarantee of compliance with the secrecy and publicity of legal proceedings, but in practice there may be cases of violation of these constitutional rights by court staff. This circumstance may be due to the presence of gaps in the legislation that must be eliminated in order to strengthen civil society, the existence of which is impossible without ensuring the conditions for the implementation of these principles in objective reality. Thus, in the Russian Federation there is a need to develop solutions to the problems that arise on the way to the implementation of the principles of secrecy and publicity of legal proceedings. In order to solve the problems that the court staff faces in the implementation of these principles, it is necessary to develop recommendations for improving the judicial system in Russia. This study is devoted to the analysis of legal regulation of the protection of information, personal data, information on the activities of federal courts and ensuring the secrecy of legal proceedings.
