Chinese-English Translation Challenges of International Commercial Arbitral Awards
This study systematically examines typical mistranslation phenomena and their causes in Chinese-English terminology conversion through an analysis of arbitral awards issued by the China International Economic and Trade Arbitration Commission (CIETAC) and the International Court of Arbitration (ICC). The findings reveal that disparities in legal systems, language conversion barriers, and the lack of quality control mechanisms are the primary reasons for terminology deviations and syntactical issues. To address these problems, this paper proposes improvement measures from three dimensions: terminology standardization, quality control, and arbitrator language proficiency enhancement, including the establishment of a tiered terminology database, refinement of award review procedures, and specialized training programs. These recommendations not only contribute to improving the international recognition of Chinese arbitral documents but also provide new insights for the application of legal linguistics in the field of arbitration.
