Proactive Conflict Detection and Management in the Construction Industry: Integrating Multifaceted Approaches for Dispute Prevention
Despite being the critical economic driver, the construction industry in Gulf Cooperation Council (GCC) countries has been marred by increasing disputes often leading to financial losses, reputational damage, and strained relationships among stakeholders. Traditional dispute resolution methods, such as negotiation, mediation, arbitration, and litigation, are typically reactive—addressing conflicts after escalation—and costly and time-consuming. This paper provides a comprehensive review of the sources of construction disputes in the GCC region, examines the effectiveness of current dispute resolution mechanisms, identifies their limitations, and explores proactive early conflict detection and management approaches such as well-designed contracts, clear communication protocols, and robust governance frameworks. This study draws lessons from the UK construction industry where such approaches have been successfully implemented. The findings underscore the need for the GCC construction industry to shift from reactive dispute resolution to a proactive and integrated approach by embedding early conflict detection and management measures into the project life cycle.
