The article provides a scientific insight into the regulation of the preliminary contract in the Natural Law codes – the General State Laws for the Prussian States and the General Civil Code of Austria, which both had a certain impact on the Codification of Baltic Private Law of 1864 – the predecessor of the current Civil Law. The author presents an insight into evolvement of the understanding of preliminary contract in Prussian and Austrian legal doctrine during the 19th century based on the positions articulated by legal scholars, highlighting common and distinctive characteristics.
