Cietušā tiesības uz mantas atdošanu kriminālprocesā
This article explores the legal framework and practical issues related to the return of unlawfully taken property to the victim as a means of restoring violated rights in Latvian criminal procedure. It highlights regulatory gaps, emphasises the importance of property return during pre-trial proceedings, and distinguishes it from compensation. The author concludes that, in the case of movable property, the investigator or prosecutor is competent to assess ownership and decide on vindication, therefore, such decisions should not be delayed until the trial stage.
