wl-3271-The Tribal Development Paradox: Infrastructure Challenges and Social Justice for the Madia Tribe in Gadchiroli
This article explores the challenges faced by the Madia Particularly Vulnerable Tribal Group (PVTG) in Maharashtra’s Gadchiroli region, focusing on their fight for fundamental rights through democratic and constitutional means. Despite the PVTG status, and having dedicated policies aimed at their development, the community continues to suffer from severe neglect, particularly regarding essential infrastructure like road connectivity. The focus is on Vengnur village, where the lack of road connectivity and transportation isolates the community, which then worsens their socio-economic vulnerabilities and restricts their access to basic services such as healthcare and education. The article highlights the Madia community’s inspiring use of 'Letter Petition' to the judiciary, which led to improvements in infrastructure and set a precedent for other marginalized communities. The discussion also extends to the broader implications of inadequate access to justice among tribal groups, underscoring the need for systemic changes to ensure social equity. By examining the Madia community’s activism and the judicial response, the article emphasizes the importance of legal frameworks that facilitate easier access to justice, advocating for the empowerment of local courts as envisioned in Article 32(3) of the Indian Constitution. This study serves as an attempt to show the assertion of tribals and a call to action for policymakers to address the deep-rooted issues of accessibility and rights enforcement for India’s marginalized populations.
