The Criterion of Significance and Regularity of Interference in Neighbor Relations under German and Russian Law
The article uses comparative and systemic analysis to examine the most important and interrelated characteristics of neighbourhood intervention under German law: materiality and habituality. On the basis of the analysis of German law enforcement practice, the criteria by means of which it is possible to state the presence or absence of materiality and ordinariness are derived. The comparison is made to a greater extent with the draft Civil Code of the Russian Federation, since the current version of the Civil Code of the Russian Federation does not contain norms on neighbourhood rights.
